Official Rules

 

NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING. VOID OUTSIDE THE 50 UNITED STATES AND THE DISTRICT OF COLUMBIA AND WHERE PROHIBITED BY LAW.

 

NOTE: THESE OFFICIAL RULES INCLUDE AN ARBITRATION REQUIREMENT AND CLASS ACTION WAIVER, WHICH, SUBJECT TO SOME LIMITED EXCEPTIONS, REQUIRES YOU TO ARBITRATE CLAIMS YOU MAY HAVE AGAINST US ON AN INDIVIDUAL BASIS. ARBITRATION ON AN INDIVIDUAL BASIS MEANS THAT YOU WILL NOT HAVE, AND YOU WAIVE, THE RIGHT FOR A JUDGE OR JURY TO DECIDE YOUR CLAIMS, AND THAT YOU MAY NOT PROCEED IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE CAPACITY.

 

1. Eligibility: The CAMEX Scavenger Hunt (the “Sweepstakes”) is open to individuals who, as of the start of the Sweepstakes Period (defined below) are: (i) legal residents of the fifty (50) United States or the District of Columbia, (ii) have reached the age of majority in their jurisdiction of residence and are at least eighteen (18) years old, and (iii) are registered attendees of the CAMEX24 Trade Show (each, an “Eligible Entrant”).

 

Exclusions: The Sweepstakes is void outside the 50 United States and the District of Columbia (for avoidance of doubt, this means the Sweepstakes is void in Puerto Rico, Guam, and all U.S. territories and possessions) and where prohibited by law. Employees and their immediate families (spouse, parents and stepparents, siblings and stepsiblings, and children and step-children) and household members (people who share the same residence at least three (3) months out of the year) of CAMEX any other persons or entities involved in the administration of the Sweepstakes are ineligible to enter or win.

 

2. Sponsor: CAMEX, 528 E. Lorain St., Oberlin, Ohio 44074 (“Sponsor”). 

 

3. Agreement to Official Rules: Participation in the Sweepstakes constitutes entrant’s full and unconditional agreement to and acceptance of these Official Rules and the decisions of Sponsor, which are final and binding in all matters related to the Sweepstakes. Winning is contingent upon fulfilling all requirements set forth herein. An entrant may be disqualified in Sponsor’s sole discretion if he/she fails to comply with any term of these Official Rules. The Sweepstakes is subject to all federal, state and local laws. If you enter via your mobile phone, such activity will be subject to the charges pursuant to your wireless service provider’s rate plan. Please consult your wireless service provider for more information.


4. Timing: The Sweepstakes will be open beginning at 12:30 PM Eastern Standard Time (“EST”) on February 24, 2024, and will end on February 28, 2024, at 1:00 PM EST (the "Sweepstakes Period"). Sponsor’s computer is the official time-keeping device for the Sweepstakes. Entrants are responsible for determining the correct beginning and ending times of the Sweepstakes Period.  

 

5. How to Enter:

 

A.     Scavenger Hunt. During the Sweepstakes Period, an entrant must collect and submit a minimum of eight (8) of the “codes” listed at the Scavenger Hunt locations. The Scavenger Hunt locations are provided in the CAMEX mobile app (the “App”), which can be downloaded at https://www.camex.org/scavenger-hunt. The Scavenger Hunt locations are physical locations inside the Savannah Convention Center, where CAMEX24 will be held. At each location, a unique code will be on display. Participants should enter the codes into the designated field in the App and submit them as they go. Participants who identify and successfully submit via the App a minimum of eight (8) out of a total of ten (10) codes will automatically be awarded one (1) entry in the Sweepstakes. Submission of codes via the app will require participants to provide an email address. Participants who submit fewer than eight (8) codes are not eligible to win. Participants who successfully submit more than eight (8) entries will not receive additional entries. Entrants must not engage in any violent, dangerous, illegal, unsportsmanlike, or otherwise inappropriate behavior, as determined by Sponsor in its sole discretion, when participating in the Scavenger Hunt.  

 

B.     Alternate Means of Entry (“AMOE”): Entrants who do not participate in the Scavenger Hunt but still wish to enter the Sweepstakes can enter during the Sweepstakes Period by sending an e-mail with their name, mailing address to: camex@nacs.org. The email must also include the following statement: “I agree to be bound by the Official Rules of the CAMEX Scavenger Hunt.” As successfully submitted AMOE will result in the entrant receiving one (1) entry into the Sweepstakes.  


Entries must be received during the Sweepstakes Period to be eligible. There is a limit of one (1) entry per person, regardless of method of entry. Further, Sponsor will not accept more than one (1) entry per email address. Should multiple users of the same email address enter the Sweepstakes and a dispute arises thereafter regarding the identity of the entrant, the entry will be declared made by the authorized account holder of the e-mail address at the time of the entry. The “authorized account holder” is the natural person to whom the applicable Internet service provider or other organization (such as business or educational institution) has assigned the e-mail addresses. Each entrant may be required to show proof of being the authorized account holder.   

 

All entries must be complete and legible and received by the end of the Sweepstakes Period to be eligible. No software generated, robotic, programmed, script, macro or other automated entries are permitted. Incomplete, corrupted, or untimely entries are void and will be disqualified. Proof of transmission does not constitute proof of receipt by Sponsor or entry into the Sweepstakes. Sponsor is not responsible for lost, late, incomplete, damaged, stolen or misdirected entries; lost, interrupted, or unavailable network, server, or other connections; or miscommunications, computer or software malfunctions, telephone transmission problems, technical failures, garbled transmissions, damage to a entrant’s computer equipment (software or hardware), or other errors or malfunctions of any kind, whether human, mechanical, electronic or otherwise. Entries specifying an invalid, non-working, or inactive email address will be disqualified and are ineligible to win. All entries submitted in accordance with these Official Rules shall be collectively hereinafter referred to as “Eligible Entries.” Once submitted, entries will not be acknowledged or returned.

 

7. Winner Selection & Notification: At the conclusion of the Sweepstakes Period, a total of six (6)

potential winners will be randomly selected from all the Eligible Entries received during the Sweepstakes period; the odds of winning depend on the number of Eligible Entries received. Winner selection will take place on approximately February 29. The first entrant selected will be the potential winner of the Grand Prize (defined) below. Each of the next five (5) entrants selected will each be potential winners of a Second Place Prize (defined below).

 

Potential winners will be notified by Sponsor via the email address provided by the potential winner within 14 days after the end of the Sweepstakes Period. The potential winner’s mailing address will also be confirmed via email at that time. If a potential winner does not submit the information requested via the prize notification correspondence within SEVEN (7) DAYS of when the notification is sent, then they may be disqualified and an alternate potential winner may be selected via a random drawing if time permits and in Sponsor’s sole discretion. Sponsor shall have no liability for a potential winner’s failure to receive notices due to spam, junk e-mail, or other email or social media account settings or for potential winner’s provision of incorrect or otherwise non-functioning contact information.

 

NOTE: Potential winners are subject to verification by Sponsor, whose decisions are final and binding in all matters related to the Sweepstakes. An entrant is not a winner of any prize unless and until entrant's eligibility has been verified and entrant has been notified that verification is complete. Being declared a winner is contingent upon compliance with all criteria set forth in these Official Rules.

 

Potential winners may be required to execute a W-9 tax form verifying their tax identification number and to complete/provide other documentation and information required by Sponsor, such as an Affidavit of Eligibility and Liability and Publicity Release (collectively “Affidavit”) in accordance with the instructions listed in the prize notification correspondence. If a potential winner cannot be contacted, fails to claim the prize or respond to the prize notification correspondence in accordance with Sponsor’s instructions, is ineligible, or fails to timely and fully complete and return any documentation or information required by Sponsor, the prize may be forfeited and an alternate potential winner may be selected, in Sponsor’s sole discretion; provided, however, that Sponsor reserves the right not to seek an alternate potential prize winner.

 

Unless otherwise stated in the prize notification, prizes will be fulfilled within [3 weeks] following the end of the Sweepstakes Period. 

8. Prizes: One (1) Grand Prize winner will receive: one (1)
10.2-inch 9th Generation iPad (the “Grand Prize”). The Approximate Retail Value ("ARV”) of the Grand Prize is $249.00. Five (5) Second Place Prize winners will each receive one of the following prizes: (a) one (1) Case Logic bag (ARV: $25.00); one (1) Monopoly (Savannah Edition) board game set (ARV: $25), or one (1) $25.00 Amazon gift card (ARV: $25.00) (collectively, the “Second Place Prizes"). Note on prize selection: The Second Place Prizes will consist of one (1) Case Logic bag, one (1) Monopoly board game set, and three (3) Amazon gift cards. The total ARV of all prizes available in the Sweepstakes is $374.00.


All prize details are at Sponsor’s sole discretion. All applicable federal, state and local taxes are the responsibility of the winner. Prizes are awarded “as is” with no warranty or guarantee, either express or implied by Sponsor. No substitution, transfer or cash redemption of prizes is permitted, except by Sponsor, which reserves the right to substitute a prize (or portion thereof) with one of comparable or greater value.  Actual Prize may differ from promotional images. ARV of prize or prize components may differ from stated ARV and Sponsor will not award any difference between actual value and ARV. Winner must continue to comply with all terms and conditions of these Official Rules, and winning is contingent upon fulfilling all requirements.


9. Publicity: Acceptance of the prize shall constitute and signify winner’s agreement and consent that Sponsor and its designees (i) may use the winner’s name, city, state, likeness, entry and/or prize information for promotional, advertising or other purposes, worldwide, in any and all media now known or hereafter devised, including the Internet, without limitation and without payment, notification, permission or other consideration, except where prohibited by law.

 

10. Release of claims: To the fullest extent permitted by applicable law, by entering or accepting any Prize, winner agrees to release and hold harmless Sponsor, and any party associated with the development or administration of this Sweepstakes, and their parents, subsidiaries, and affiliated entities, and each of their respective officers, directors, members, shareholders, employees, independent contractors, agents, representatives, successors and assigns (collectively, “Released Entities”), from any and all liability whatsoever in connection with this Sweepstakes, including without limitation legal claims, costs (including travel expenses), injuries, losses, damages, demands or actions of any kind (including FOR personal injuries, death, damage to, loss or destruction or property, rights of publicity or privacy, defamation, or portrayal in a false light) (collectively, “Claims”).

 

11. Limitations of Liability & Disclaimer of Warranties: To the fullest extent permitted by applicable law, you accept and agree that the Released Entities are not responsible for and shall NOT BE LIABLE FOR ANY DAMAGES OR LIABILITIES (INCLUDING DIRECT, INCIDENTAL, INDIRECT, SPECIAL, OR CONSEQUENTIAL DAMAGES) ARISING FROM OR RELATING IN ANY WAY TO YOUR PARTICIPATION IN THE SWEEPSTAKES OR ACCEPTANCE OR USE OF ANY PRIZE, REGARDLESS OF LEGAL THEORY, WITHOUT REGARD TO WHETHER SPONSOR OR ANY OTHER RELEASED ENTITY HAS BEEN WARNED OF THE POSSIBILITY OF SUCH DAMAGES, AND EVEN IF A REMEDY FAILS OF ITS ESSENTIAL PURPOSE.

 

WITHOUT LIMITING THE FOREGOING SENTENCE, SPONSOR SHALL NOT BE LIABILITY TO YOU IN RELATION TO: (1) technical failures of any kind, including malfunctions, interruptions, or disconnections in phone lines or network hardware or software AND any garbled or delayed transmissions; (2) unauthorized human intervention in any part of the entry process or the Sweepstakes; (3) ANY printing, typographical, technical, computer, network or human error which may occur in the administration of the Sweepstakes, the announcement of the prizes or in any Sweepstakes-related materials and any incorrect or inaccurate information resulting therefrom; (4) late, lost, undeliverable, damaged or stolen mail OR ENTRIES; or (6) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Sweepstakes or receipt or use or misuse of any prize (including any travel/activity related thereto).

 

RELEASED ENTITIES MAKE NO WARRANTIES, REPRESENTATIONS OR GUARANTEES, EXPRESS OR IMPLIED, IN FACT OR IN LAW, IN REGARD TO THIS SWEEPSTAKES OR THE MERCHANTABILITY, QUALITY OR FITNESS FOR A PARTICULAR PURPOSE REGARDING ANY PRIZE OR ANY COMPONENT OF ANY PRIZE.

 

SOME JURISDICTIONS DO NOT PERMIT THE EXCLUSION OF CERTAIN WARRANTIES AND/or DAMAGES, SO SOME OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.

 

12. Indemnification: To the maximum extent permitted by law, each entrant agrees to defend, indemnify, and hold harmless Sponsor from and against any and all claims, actions, suits, or proceedings, as well as any and all losses, liabilities, damages, costs and expenses (including reasonable attorneys’ fees) arising out of or accruing from (i) any entry or other material submitted by the entrant that infringes any copyright, trademark, trade secret, trade dress, patent or other intellectual property or proprietary right of any person; (ii) any misrepresentation made by entrant or the breach of any representation or warranty made by entrant in connection with the Sweepstakes; or (iii) any non-compliance by the entrant with these Official Rules or any other rules or guidelines provided by Sponsor in connection with the Sweepstakes.

 

13. General Conditions: Sponsor reserves the right to cancel, suspend, and/or modify the Sweepstakes, or any part of it, if any fraud, technical failures or any other factor (including, without limitation, disease, epidemic, or pandemic) impairs the integrity or proper functioning of the Sweepstakes or otherwise prevents it from running as planned, all as determined by Sponsor in its sole discretion. If modified or terminated, Sponsor may, in its sole discretion, determine the winners by random drawing from among all non-suspect, Eligible Entries received up to time of such action; provided, however, that Sponsor will have no obligation to select a winner or award any prize. Sponsor, in its sole discretion, reserves the right to disqualify any individual it finds to be tampering with the operation of the Sweepstakes or to be acting in violation of the Official Rules or in an unsportsmanlike, disruptive, unsafe, or otherwise inappropriate manner at any point while participating in the Sweepstakes or attending CAMEX24 and void all associated entries. Any attempt by any person to deliberately undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages and other remedies (including attorneys’ fees) from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. All interpretations of these Official Rules and decisions by Sponsor are final.

 

14. Disputes; Agreement to Arbitrate; Choice of Law & Forum: You and Sponsor agree that if there is any controversy, claim, or action arising out of or connected with this Sweepstakes, these Official Rules, or any prize awarded (“Dispute”), both parties shall first try in good faith to settle such Dispute by providing written notice to the other party describing the facts and circumstances of the Dispute (each, a “Dispute Notice”) and allowing the receiving party thirty (30) days in which to respond to or settle the Dispute.


All Dispute Notices must: (1) be personally signed by the party sending the Dispute Notice; (2) include that party’s name, physical address, and email address; (3) describe with specificity the nature and basis of the Dispute and include any supporting documentation in the party’s possession; and (4) set forth the alleged damage and harm suffered and the specific relief sought with a calculation for it. Each Dispute Notice is limited to a single Dispute between you and Sponsor. As such, your Dispute and the Disputes of other parties may not be combined into a single Notice. Sponsor will send a Dispute Notice to you at the email address included in your entry. You may send a Dispute Notice to Sponsor at [528 E. Lorain St. | Oberlin, OH 44074].

 

Both you and Sponsor agree that the foregoing dispute resolution procedure (the “Informal Resolution Procedure”) is a condition precedent that must be satisfied before initiating any arbitration or litigation against the other party. If any aspect of the Informal Resolution Procedure has not been met, the parties agree that (i) a court of competent jurisdiction can enjoin the filing or prosecution of any arbitration or litigation and (ii) unless prohibited by law, no arbitration administrator shall accept or administer an arbitration or demand fees in connection with the Dispute.

 

IF ANY DISPUTE CANNOT BE RESOLVED BY THE INFORMAL RESOLUTION PROCEDURE, YOU AGREE THAT SUCH DISPUTE WILL BE DECIDED BY BINDING ARBITRATION ON AN INDIVIDUAL BASIS. ARBITRATION ON AN INDIVIDUAL BASIS MEANS THAT YOU WILL NOT HAVE, AND YOU WAIVE, THE RIGHT TO HAVE A JUDGE OR JURY TO DECIDE YOUR CLAIMS, AND THAT YOU MAY NOT PROCEED IN A CLASS, CONSOLIDATED, COLLECTIVE, OR REPRESENTATIVE CAPACITY. OTHER RIGHTS THAT YOU AND WE WOULD OTHERWISE HAVE IN COURT WILL NOT BE AVAILABLE OR WILL BE MORE LIMITED IN ARBITRATION, INCLUDING DISCOVERY AND APPEAL RIGHTS. All such Disputes shall be submitted to JAMS (www.jamsadr.com) for binding arbitration under its rules then in effect by one arbitrator to be mutually agreed upon by both parties. Notwithstanding any other provision herein, the arbitration shall be conducted in accordance with the JAMS Consumer Arbitration Minimum Standards (https://www.jamsadr.com/consumer-minimum-standards/) if it is determined by JAMS or the arbitrator that these standards are applicable to the Dispute. The location of any hearings will be determined by the applicable JAMS rules, provided that if the claim is for $10,000 or less, you may choose to have the arbitration conducted (1) solely on the basis of the documents submitted to the arbitrator or (2) through a non-appearance based hearing by teleconference or videoconference.

 

Without limiting any other provision of this section, you agree that the arbitrator, and not any federal, state, or local court or agency, shall have exclusive authority to resolve any Dispute arising under or relating to the interpretation, applicability, enforceability, or formation of these Official Rules, including any claim that all or any part of these Official Rules are void or voidable. For the avoidance of doubt, you and Sponsor agree that the arbitrator shall have the exclusive power to rule on his or her own jurisdiction, including any objections with respect to the existence, scope, or validity of this agreement to arbitrate or the arbitrability of any claim or counterclaim. The arbitrator may award (on an individual basis) any relief that would be available in a court. The award rendered by the arbitrator may be confirmed and enforced in any court having jurisdiction thereof.

 

In lieu of arbitration either you or Sponsor may (1) bring an individual claim or elect to resolve a Dispute in small claims court in the United States, consistent with any applicable jurisdictional and monetary limits that may apply (so long as the action is litigated exclusively in small claims court and is not removed or appealed to a court of general jurisdiction) and (2) file an individual claim in court to enjoin the infringement or other misuse of its intellectual property rights. In addition, nothing in these Official Rules prohibits you or us from bringing issues to the attention of federal, state, or local agencies. Such agencies can, if the law allows, seek relief against us on your behalf (or vice versa).

 

All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the United States (including federal arbitration law) and the State of Ohio without giving effect to any choice of law or conflict of law rules (whether of the State of Ohio or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Ohio. You and Sponsor acknowledge that these Official Rules evidence a transaction involving interstate commerce. Any arbitration conducted pursuant to this section shall be governed by the Federal Arbitration Act (9 U.S.C. §§ 1-16).


Except for claims properly lodged in a small claims court in the United States, any disputes or claims not subject to the arbitration agreement in this section shall be resolved by a court located in the State of Ohio and you agree and submit to the exercise of personal jurisdiction of such courts for the purpose of litigating any such claim or action.

 

15. Entrant's Personal Information: Information collected from entrant will be used solely for the purpose of administering the Sweepstakes and awarding prizes and will not be shared with third parties except as necessary for prize fulfillment. By participating in the Sweepstakes, you agree to this use of your information.

 

16. Winner List: For a winner list and/or copy of these Official Rules, send a hand-printed, self-addressed, stamped envelope to CAMEX “Scavenger Hunt” Sweepstakes, Membership [528 E. Lorain St., Oberlin, OH 44074] by August 31, 2024. VT residents may exclude return postage. No mechanically reproduced or photocopied requests allowed. You cannot enter using this address; entries mailed to this address will be discarded.
